According to the Jones Act (46 U.S. Code § 30104), “A seaman injured in the course of employment or, if the seaman dies from the injury, the personal representative of the seaman may elect to bring a civil action at law, with the right of trial by jury, against the employer.”

WHO IS PROTECTED BY THE JONES ACT?

Generally, anyone who works or contributes his skill or trade to the operation of the boat, barge, ship, fishing boat, cruise ship, charter boat, casino ship, another type of vessel, or an offshore drilling rig, can be referred to as a seaman.

However, to be considered a seaman for the medical and financial compensation afforded seamen under the Jones Act, you must possess the following qualities:

  • You are involved in traditional maritime trades or non-maritime trades;

  • You contribute a significant amount of your time to the ship, vessel, or fleet (usually 30%);

  • Your work contributes to the main objective of the ship, vessel, or fleet; and

  • Your ship, vessel, or fleet is in navigation.
